If anyone has attended an event in downtown Atlanta and the surrounding cities of Atlanta lately, you have probably noticed the proliferation of scooters and motorcycles. The drivers often totally disregard the scooters and the scooter drivers, on the other hand, do not do a good job turning signals on and making sufficient eye contact with other drivers. Both behaviors are the cause of an increase of motorcycle and scooter accidents in the Atlanta area. With all of the congestions surrounding events in and around the cities of Atlanta, traveling via scooter makes sense but it is dangerous. They are quick and easy ways to navigate traffic and get to where you are going, but are scooters safe, and what is the law on the road regarding the use of scooters?
Electric Scooter Laws
According to the Atlanta Police Department (“APD”), the city of Atlanta ordinance that applies to scooters “may operate in vehicle travel lanes, in bike lanes, and along shared use paths throughout the city.”
All applicable state and local laws:
- Electric scooters must obey all traffic laws.
- Scooters are not allowed on sidewalks and pedestrian-only areas.
- Operation of scooters are allowed within city parks, but cannot be used on sidewalks or spaces solely for pedestrians
- Electric scooter riders “must yield to pedestrians” on the shared pathways.
Motorcycle and Scooter Accidents
In the U.S nearly 5,000 deaths are of people riding motorcycles, in the calendar year of 2017. Motorcyclists fatalities occurring 28 times more often those of passenger vehicle occupants, based on per mile traveled. The same can be said for scooter accidents. While they do not result in as many deaths, scooter accidents happen more frequently than many other types of accidents involving other vehicles. Whatever the reason, we see a prolific jump in these electronic scooter accidents. While electric scooter accidents do not result in fatalities at the rate of motorcycle accidents, they do tend to result in injuries which are much more severe than car accidents. If you have been injured from a motorcycle or scooter accident, we highly recommend seeking legal representation.
